What Is Federal Workers' Compensation?

Federal Work Comp Is Not State Workers' Comp — Here's How It Works

Federal workers' compensation — often called federal work comp or federal workmans comp — is the benefits program for federal civilian employees injured on the job or made ill by their work. It is created by the Federal Employees' Compensation Act (FECA) and administered by the U.S. Department of Labor's Office of Workers' Compensation Programs (OWCP), not by the New York State Workers' Compensation Board. FECA covers medical treatment, continuation of pay, wage-loss compensation, schedule awards for permanent impairment, vocational rehabilitation and, in the worst cases, death benefits for survivors.

Because it is a federal program, everything about it is different from the state system: the forms (CA-1, CA-2, CA-7, CA-16, CA-17, CA-20), the deadlines, the fee schedule, the provider enrollment, and the standard of medical evidence. A doctor who treats New York State comp and no-fault patients is not automatically enrolled with the DOL and may not know how a federal claim is adjudicated. A federal workers' compensation doctor is a physician who is enrolled with OWCP, understands FECA, and writes the reports a Department of Labor claims examiner needs to accept a claim and authorize care.

Federal Injury Specialists was built to be that clinic. Our Medical Director, Eugene Liu, MD, a fellowship-trained spine and musculoskeletal specialist, is the attending physician of record; Charles Andola, PA-C, provides follow-up care under his supervision; and owner Alex Sherman, PT, and our licensed physical therapists deliver prescribed rehabilitation on site.

Your Benefits Under FECA

What Federal Work Comp Pays For — and How We Help You Get It

FECA benefits are only as good as the medical evidence behind them. Each one below depends on your attending physician's reports, which is where a federal workmans comp clinic earns its keep.

Medical treatment

All reasonable and necessary treatment for the accepted condition — physician visits, imaging, physical therapy, injections, surgery, medications and medical travel — billed directly to OWCP with no co-pay or deductible. We: evaluate, treat, and obtain authorizations.

Continuation of pay (COP)

For a traumatic injury reported on Form CA-1 within 30 days, your agency continues your regular pay for up to 45 calendar days of disability. We: provide the medical evidence of disability your agency needs to keep COP running.

Wage-loss compensation

After COP ends, or for occupational disease claims, OWCP pays two-thirds of your pay rate (three-fourths with dependents), tax-free, for periods you can't work. Claimed on Form CA-7. We: document disability for each period and complete CA-17 duty-status reports.

Schedule award

Compensation for permanent impairment of listed body parts — arms, legs, hands, feet, eyes, hearing and certain organs — after maximum medical improvement, rated under the AMA Guides. We: provide the medical basis and impairment documentation.

Light duty & return to work

Your agency may offer limited duty based on your restrictions. Accepting suitable work doesn't close your claim; refusing suitable work can affect compensation. We: write specific, defensible restrictions and coordinate with your agency's injury compensation specialist.

Recurrence & consequential injury

If an accepted injury flares up (Form CA-2a) or causes a new problem, benefits can resume or expand — but only with medical evidence linking it to the original condition. We: document the connection so OWCP treats it as part of the accepted claim.

Benefit eligibility and amounts are determined solely by OWCP under FECA; this is general information, not legal advice.

Who We Treat

Federal Workers' Comp Care for USPS, VA, TSA and Every Federal Agency in NYC

Federal jobs are physical, and the injuries follow the work. Letter carriers walk 10 or more miles a day with a loaded satchel and get shoulder, back, knee and foot injuries; mail handlers and VA staff lift, push and transfer patients and get lumbar and rotator-cuff injuries; TSA officers and federal law-enforcement personnel stand for hours, lift bags and respond to incidents. We treat the full range of federal work injuries under FECA:

Lower back & lumbar disc injuries Neck & cervical strain Rotator cuff & shoulder injuries Knee & meniscus injuries Carpal tunnel & repetitive strain Plantar fasciitis & foot/ankle injuries Hip, elbow & wrist injuries Slip, trip & fall injuries Lifting & overexertion injuries Dog bites & on-route injuries On-duty vehicle accidents Aggravation of arthritis or prior conditions

Agencies we see most

U.S. Postal Service · Department of Veterans Affairs (including James J. Peters VA Medical Center) · TSA · CBP & ICE · FBI, DEA & U.S. Marshals · Bureau of Prisons · Department of Defense civilians · SSA, IRS, HUD, EPA, GSA and all other federal agencies. Not covered under FECA: active-duty military, most private contractors, and New York State or City employees.

How a Federal Work Comp Claim Moves Through Our Clinic

The federal workmans comp process from the day you're hurt to the day you're back at full duty — and what our team does at each step.

1

Report it

File CA-1 (traumatic) or CA-2 (occupational) in ECOMP — within 30 days for COP — and ask your agency for Form CA-16.

2

See us

Dr. Liu evaluates you, orders imaging if needed, and writes the narrative report establishing diagnosis and causal relationship.

3

Get treated

Prescribed physical therapy starts in our clinic. Our case manager secures OWCP authorizations for anything that needs prior approval.

4

Stay documented

CA-17 duty-status reports at every visit; medical evidence for CA-7 wage-loss claims and light-duty decisions.

5

Resolve

Return-to-work clearance, recurrence documentation, or the medical basis for a schedule award if impairment is permanent.

Why the doctor matters

OWCP decides claims on paper. A report that doesn't state causal relationship with medical reasoning — or is signed by someone who isn't a "physician" under FECA — gets a legitimate claim denied.

One roof, one chart

Physician, PA and physical therapists share a single record, so your CA-17 restrictions, therapy notes and narrative reports never contradict each other.

Denied? We can help

Most medical-evidence denials can be addressed with a proper narrative report and a request for reconsideration. We supply the medical side; a FECA representative can handle the rest.

📞  Call (718) 432-1323
+What is a federal workers' compensation doctor?

A physician enrolled with the U.S. Department of Labor's OWCP who treats federal employees under FECA and can serve as the attending physician on the claim — meaning an MD or DO (or podiatrist, dentist, clinical psychologist, optometrist, or chiropractor for spinal subluxation) who signs Forms CA-16, CA-17 and CA-20 and writes the narrative reports OWCP relies on. At Federal Injury Specialists that physician is Eugene Liu, MD.

+Is federal work comp the same as federal workmans comp?

Yes. "Federal workers' compensation," "federal work comp," "federal workmans comp," "DOL comp," "OWCP" and "FECA" all refer to the same program: benefits for injured federal civilian employees under the Federal Employees' Compensation Act, administered by the Department of Labor.

+How much does federal workers' comp pay?

Medical care for the accepted condition is paid in full to enrolled providers. For a traumatic injury, your agency continues your regular pay for up to 45 days (COP). After that, or for occupational disease, OWCP pays wage-loss compensation at two-thirds of your pay rate, or three-fourths if you have at least one dependent, tax-free. Schedule awards for permanent impairment are paid separately based on the rated percentage.

+Can I use my own doctor for federal workers' comp?

Yes. FECA gives you the right to choose your own qualified physician; you do not have to use one selected by your agency. Ask for Form CA-16 for a traumatic injury and bring it to your first visit. Changing physicians later generally requires OWCP's approval.

+Does federal workers' comp cover physical therapy?

Yes, when prescribed by a qualified physician for an accepted condition and authorized as required. At Federal Injury Specialists the prescribing physician and the physical therapists are in the same building, so treatment and documentation stay coordinated.

+How long do I have to file a federal work comp claim?

Report a traumatic injury within 30 days to protect continuation of pay. The legal deadline to file a FECA claim is generally three years from the injury, or from the date you knew (or should have known) an occupational condition was work-related. File as soon as possible — late filing is a leading cause of problems.

+Do you take New York State workers' comp or no-fault?

Federal Injury Specialists is dedicated to federal workers' compensation (DOL/OWCP). If you're not a federal employee, call (718) 432-1323 and our front desk will point you to the right care.
